Is your business Divorce protected?

Being uncomfortable planning for a potential divorce before you're even married is natural. However, when you have built your business from the ground up, you want to do everything in your power to protect it, and unfortunately most entrepreneurs don't take divorce into consideration, and don't realize that it is one of the most common risks to the security and continued viability of a business.  Of course you're going to do everything in your power to make sure your marriage works.  And, it probably will. But that doesn't mean you shouldn't prepare for the possibility that it won't.

 

Here are a few basic steps that business owners can take, early in their marriage, to ensure that their business gets through a divorce unharmed.  

 

Create a prenuptial agreement: where the spouses can agree on the status of various pieces of property, in the event of divorce.

 

Minimize your spouse's involvement in the business: If your spouse played an integral role in the development or operation of the business, a divorce court may well find that they are entitled to a share of the business as compensation for their efforts.

 

Be prepared to give up some assets in exchange for keeping the business:  In the event of a divorce, no matter how proactive you were, a court might still find that your spouse is legally entitled to a share of the business. In most cases, in order to keep full control of your business, you may have no choice but to buy out your spouse's share.

 

There are many other legal and financial measures you can take in order to maximize the chances that of protecting your business from a divorce.  All of these measures depend, however, on advance planning and communication between you and your spouse.

 

 
Personal Injury - Slip and Fall    

 

Slip and fall accidents or trip and fall accidents are a common premises liability claim and can occur on sidewalks, parking lots, restaurants, retail stores and many other types of property.

 

Under common law principles, property owners have certain responsibilities depending on the classification of the person entering their property such as invitees, licensees and trespassers.  Depending on how you are classified can affect your ability to recover for your injuries.

Extend a lifeline to help abandoned dogs.

 

WAGS Rescue & Referral (WAGS) is a small group of volunteers from Bucks County, Philadelphia and Montgomery County, PA that started because they wanted to help dogs affected by Hurricane Katrina by placing them in loving and safe homes. The purpose of WAGS Rescue & Referral is to match people with dogs who lost their homes or never had one, through no fault of their own as well as heighten awareness that no animal, of any kind, is disposable! These dogs have been displaced for any number of reasons such as natural disasters, poverty, foreclosures, negligence, abuse, relocation.  Unfortunately some people think their "pets" are disposable.

 

Service to others is deeply embedded in our firm and remains an important part of our mission.  Members of our firm have been involved with the organization and have been fostering animals in need.  Here at The Law Offices of Michael Kuldiner, P.C. our goal is to develop engaged citizens who are actively involved in work that betters our local communities and the world at large.

Back to School Safety

 

With the start of the new school year, we would like to remind parents and drivers to keep kids safe as they make their commute to and from school.  It is recommended that parents be proactive and take the time to talk about safety with their kids before they head back to school.  

 

Adults can teach and model the following safety behaviors that all children should follow, even if they don't walk to school every day:

 

Here are some simple reminders for drivers:

  • Slow down and be especially alert in the residential neighborhoods and school zones
  • Take extra time to look for kids at intersections, on medians and on curbs
  • Enter and exit driveways and alleys slowly and carefully
  • Watch for children on and near the road in the morning and after school hours
  • Reduce any distractions inside your car so you can concentrate on the road and your surroundings. Put down your phone and don't talk or text while driving

Reminder for your kids:

  • They should cross the street with an adult until they are at least 10 years old
  • Cross the street at corners, using traffic signals and crosswalks
  • Never run out into the streets or cross in between parked cars
  • Make sure they always walk in front of the bus where the driver can see them
